1. Acceptance of These Terms

By visiting or using the Site, you confirm that you are at least 18 years old and that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. These Terms apply to your use of the website only. They are separate from the terms that govern any actual hunt (see Section 9).

2. The Site Is Informational Only

The Site is a static, informational marketing website. It exists to describe WTX Outfitters, the types of guided hunts we offer (including sandhill crane, duck, goose, dove, hog, prairie dog, and pigeon hunts on private land), and how to contact us.

• The Site does not provide user accounts, logins, online checkout, online payment, or online booking. All inquiries and bookings are handled by phone or email.
• Hunt availability, dates, seasons, pricing, package details, and other information on the Site are provided for general information only, may be incomplete or out of date, and are subject to change at any time without notice.
• Nothing on the Site is a binding offer, guarantee, or commitment to provide any hunt, date, price, or result. A booking is only confirmed when we expressly agree to it and, where applicable, you sign our booking agreement and pay any required deposit. Seasons, bag limits, and legal hunting conditions are set by government agencies and are outside our control (see the Hunting Disclaimer).

3. Intellectual Property

All content on the Site — including text, photographs, images, graphics, logos, the “WTX Outfitters” name and branding, layout, and design — is owned by WTX Outfitters or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and access the Site for your own personal, non-commercial use. You may not copy, reproduce, republish, download, distribute, modify, frame, scrape, or otherwise use any content from the Site — including our photographs — without our prior written permission. Photographs of hunts, harvests, guides, and property are especially reserved; please contact us if you wish to request permission to use any content.

4. Acceptable Use

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site, its servers, or any related systems;
• Introduce viruses, malware, or other harmful code;
• Interfere with or disrupt the Site or the networks or servers used to make it available;
• Use automated means (bots, scrapers, crawlers) to harvest content or data except for legitimate search-engine indexing;
• Misrepresent your identity or impersonate any person; or
• Use the Site in any way that could damage, disable, or impair it or interfere with any other party’s use.

We may suspend, restrict, or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms.

5. No Warranties (“As Is”)

THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WTX OUTFITTERS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any information on the Site is accurate, complete, current, or reliable. You use the Site at your own risk.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WTX OUTFITTERS AND ITS OWNERS, MEMBERS, EMPLOYEES, GUIDES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

This section addresses liability relating to the website only. Liability relating to an actual hunt is addressed in our Hunting Disclaimer, Booking & Cancellation Terms and in the written booking agreement and liability release you sign before hunting. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

7. Third-Party Links

The Site may contain links to third-party websites or resources (such as government wildlife agencies, licensing portals, weather services, or social media). These links are provided for your convenience only. We do not control and are not responsible for the content, accuracy, policies, or practices of any third-party site. Accessing third-party sites is at your own risk and subject to their terms and policies.

8. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless WTX Outfitters and its owners, members, employees, guides, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Site or your violation of these Terms or applicable law.

9. Relationship to Booking and Hunt Terms

These Terms govern the website only. They do not govern the actual guided hunt or your relationship with us as a hunting client. The terms that apply to booking and participating in a hunt — including licensing responsibilities, deposits, balances, cancellation and refund policies, weather and rescheduling, conduct rules, assumption of risk, and liability releases/waivers — are set out separately in our Hunting Disclaimer, Booking & Cancellation Terms and in the written booking agreement and liability release you must sign before hunting. If there is any conflict between these website Terms and the signed booking agreement regarding a hunt, the signed booking agreement controls for that hunt.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. To the extent permitted by law, any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Lubbock County, Texas, and you consent to the personal jurisdiction and venue of those courts. 11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Changes are effective when posted. Your continued use of the Site after changes are posted means you accept the revised Terms.

12. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and WTX Outfitters regarding your use of the Site and supersede any prior understandings regarding the Site.
