Hunting Disclaimer, Booking & Cancellation Terms, and Assumption of Risk

Please read this document carefully before booking or hunting. By booking a hunt, paying a deposit, or participating in a hunt, you acknowledge and agree to these terms. These terms are in addition to, and separate from, the written booking agreement and liability release/waiver you will be required to sign before hunting.

1. Licensing, Stamps, and Legal Compliance Are Your Responsibility

Every hunter is solely responsible, at their own expense, for obtaining and carrying all licenses, permits, stamps, and endorsements required to hunt legally in Texas, and for hunting in full compliance with all applicable federal, state, and local laws and regulations. This includes, without limitation:

• A valid Texas hunting licenseappropriate to the game and the hunter’s residency status, issued by the Texas Parks & Wildlife Department (TPWD);
• For migratory game birds (such as sandhill crane, duck, goose, dove, and other migratory species): a Migratory Game Bird endorsement, Harvest Information Program (HIP) certification, and any species-specific permits (for example, a sandhill crane permit where required);
• For waterfowl (ducks and geese): a valid federal Migratory Bird Hunting and Conservation Stamp (“federal duck stamp”) and any state waterfowl stamp/endorsement required;
• Compliance with all rules of TPWD and, for migratory birds, the U.S. Fish & Wildlife Service (USFWS), including legal shooting hours, methods, non-toxic shot requirements for waterfowl, plugged-shotgun requirements, tagging, and possession and transport rules.

Seasons, bag limits, and possession limits are set by TPWD and USFWS and change every year. Hunt dates offered by WTX Outfitters are subject to those regulations. It is each hunter’s responsibility to confirm the current season dates, bag limits, legal methods, and license/stamp requirements before the hunt. We can share general guidance, but we do not provide legal advice on licensing, and we are not responsible for a hunter’s failure to obtain proper licensing or to comply with the law. A hunter who cannot lawfully hunt may be prohibited from participating without refund.

2. No Guarantee of Harvest

Hunting is hunting — success is never guaranteed. Harvesting game depends on many factors beyond anyone’s control, including weather, wind, temperature, water conditions, crop and food conditions, bird and animal movement and migration timing, hunting pressure, and each hunter’s own skill, marksmanship, patience, and physical ability.

• WTX Outfitters does not guarantee that you will see, shoot at, or harvest any particular species, number, or size of game.
• Fees are charged for guided access, guiding services, and the hunting experience — not for game harvested. No refund or credit is owed because game was scarce, did not appear, or was not harvested.
• Any statements about typical results, “good years,” or past success are general information only and are not promises of future results.

3. Firearm Safety, Conduct, and Guide Instructions

Safety is the top priority on every hunt. As a condition of participating, each hunter agrees to:

• Treat every firearm as if it is loaded, keep the muzzle pointed in a safe direction at all times, keep the finger off the trigger until ready to shoot, and be certain of the target and what is beyond it;
• Follow all safety rules and all instructions given by WTX Outfitters guides and staff regarding safe zones of fire, shooting lanes, handling of firearms and ammunition, blinds, decoys, boats, vehicles, and dogs;
• Handle firearms and ammunition responsibly, use appropriate eye and ear protection, and unload and safely case firearms when directed;
• Never handle firearms carelessly, take unsafe shots, or endanger other hunters, guides, dogs, livestock, property, or bystanders.

Zero tolerance for unsafe or impaired behavior. WTX Outfitters may immediately stop a hunt and remove any person who, in our sole judgment, behaves unsafely, refuses to follow guide instructions, handles firearms recklessly, or is under the influence of alcohol or drugs. A person removed for these reasons is not entitled to any refund, and may be barred from future hunts.

4. Assumption of Risk

Hunting is a physically demanding activity that involves inherent and unavoidable risks that cannot be eliminated regardless of the care taken. These risks include, without limitation:

• Firearms and ammunition, including the risk of accidental or negligent discharge, ricochet, and hearing or vision injury;
• Uneven, wet, muddy, or slippery terrain, holes, fences, agricultural equipment, water, and boats;
• Weather and environmental conditions, including cold, heat, sun, wind, storms, and hypothermia or heat illness;
• Wildlife, insects, snakes, livestock, and hunting dogs;
• Physical exertion such as walking, carrying gear, climbing in and out of blinds and vehicles, and fatigue;
• Transportation to and around remote private land; and
• The actions or inactions of other hunters, guides, or third parties, and the possibility that help or medical care may be delayed.

By booking and participating, each hunter (and the parent or guardian of any minor) knowingly and voluntarily assumes all such risks, whether or not specifically listed, and whether known or unknown, including risks of serious personal injury, permanent disability, property damage, and death.

Written release required. Before participating in any hunt, each hunter (and the parent or legal guardian of any minor) will be required to read and sign a separate liability release, waiver, and assumption-of-risk agreement. Participation is not permitted without a signed release. 5. Booking, Deposits, Payment, and Cancellation

Bookings are made by phone or email and are confirmed only when WTX Outfitters expressly accepts the booking and receives any required deposit. The following terms apply to bookings. The specific amounts, timeframes, and windows below must be set by WTX Outfitters and confirmed with your attorney.

Weather and conditions. Hunts generally proceed in typical seasonal weather. WTX Outfitters may, in its sole judgment, delay, shorten, cancel, or reschedule a hunt for safety reasons (for example, lightning, flooding, dangerous conditions, or unsafe access). Cancellation or changes by WTX Outfitters. In the unlikely event WTX Outfitters must cancel a confirmed hunt for reasons within our control, we will offer to reschedule or provide a refund or credit of amounts paid for that hunt. 6. Insurance

Each hunter is encouraged to carry their own health, accident, and, where appropriate, trip-cancellation and personal liability insurance. WTX Outfitters does not provide medical, accident, or trip insurance for hunters. 7. Minors

Hunters under the age of 18 (“minors”) may participate only with the express consent of, and where required the presence and supervision of, a parent or legal guardian, and in compliance with Texas hunter-education and supervision requirements. A parent or legal guardian must read and sign the liability release, waiver, and assumption-of-risk agreement on the minor’s behalf before the minor may participate. 8. Alcohol and Drugs Prohibited

The possession or consumption of alcohol or the use of any illegal drug, cannabis, or impairing substance is strictly prohibited before and during any hunt and while handling firearms. Anyone who appears to be impaired may be removed from the hunt immediately and without refund (see Section 3). Hunters taking prescription medication that may cause impairment should not hunt or handle firearms while affected.

9. Property, Private Land, and Wildlife Rules

Hunts take place on private land. Hunters must respect the property, gates, fences, crops, livestock, equipment, and roads, follow all posted and stated rules, stay within designated hunting areas, and follow all guide instructions regarding access and boundaries. Retrieval and handling of harvested game must follow legal tagging, possession, and transport rules. Hunters are responsible for any damage they cause to property through misuse or failure to follow instructions.

10. Limitation of Liability

To the fullest extent permitted by law, and except as otherwise set out in the signed liability release and booking agreement, WTX Outfitters and its owners, members, employees, guides, agents, and landowners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to a hunt. Nothing in this website document limits or waives rights in a manner inconsistent with the signed release or with applicable Texas law; the signed liability release and booking agreement control the parties’ legal rights regarding a hunt. 11. Governing Law and Venue

These terms and any hunt with WTX Outfitters are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. To the extent permitted by law, any dispute will be brought exclusively in the state or federal courts located in Lubbock County, Texas. 12. Changes to These Terms

We may update this document from time to time. The version in effect for your hunt is the version provided to you at booking and the terms of your signed booking agreement and release. The “Last updated” date above shows when this document was last revised.
